How to File a Complaint Against a Police Officer in India – Legal Guide

Every citizen has the right to file a formal complaint against police misconduct. Whether it is a refusal to register an FIR, illegal detention, bribery, or custodial torture — there are established legal channels for accountability.

Where to File a Complaint Against Police

    1 – Within the police departmentWrite a complaint to the Superintendent of Police (SP) or Deputy Commissioner of Police (DCP) of the district. If the SP is involved, approach the DGP (Director General of Police) of the state.

    2 – State Human Rights Commission (SHRC)File an online or written complaint with the State Human Rights Commission. Available in every state. Can take suo motu cognizance of police brutality reported in media.

    3 – National Human Rights Commission (NHRC)File at nhrc.nic.in for serious cases of custodial death, torture, or gross rights violations. NHRC can direct states to pay compensation.

    4 – Judicial Magistrate / Sessions CourtFile a private complaint under Section 200 CrPC in the Magistrate's court. A magistrate can order police to investigate or take action.

    5 – High Court Writ PetitionFile a Habeas Corpus (illegal detention) or Writ petition under Article 226 of the Constitution in the High Court. Courts can order immediate release or inquiry against officers.

    6 – Anti-Corruption BureauFor bribery or corruption by police officers, approach the state Anti-Corruption Bureau or Vigilance Commission. You can also call the ACB hotline.

Your Rights If Police Misconduct Occurs

  • 1You have the right to know the name and badge number of any police officer — they must display it or provide it on request.
  • 2Custodial torture is a criminal offence under IPC and punishable. You can file an FIR against the officer.
  • 3Illegal arrest or detention can be challenged via Habeas Corpus petition in the High Court — often heard within 24 hours.
  • 4A refusal to register an FIR for a cognizable offence is an offence under IPC. You can report it to the SP or Magistrate.
  • 5Women must not be arrested after sunset or before sunrise without a female officer present and a magistrate's order.
  • 6All arrested persons are entitled to legal counsel. Police cannot deny access to a lawyer.
