What decides the category is the gravity of the offence in law, not how serious it feels. Minor assault without injury, public nuisance, defamation, simple trespass and most neighbour disputes are non-cognizable. Because the power to arrest is a serious intrusion, the law reserves it for graver crimes.

The First Information Report is the hinge on which any criminal case turns. It is recorded under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced Section 154 of the old Code of Criminal Procedure. Until an FIR exists the police have no legal basis to investigate, arrest, or seize evidence.
Only a cognizable offence gets an FIR. "Cognizable" means grave enough that an officer may arrest without first obtaining a warrant.
